Can I Appeal My QME Exam Score?
Yes, according to California’s Workers’ Compensation Division (WCD), you can appeal a failing QME exam grade by addressing a written communication to the administrative director.
Appeals are accepted immediately after a candidate has completed the exam and until 10 days after the date of the exam results letter.
The WCD notes that “appeals will be considered on a case by case basis.”

Appealing a QME Exam Score: What You Need To Know
According to the WCD, there are only three grounds for appealing a failing QME exam score:
- Significant procedural errors in the exam process
- Unfair discrimination
- Bias or fraud
If you decide to file an appeal, make sure to follow the requirements laid out in the California Code of Regulations (8 CCR § 11(f)(10)):
- Appeals will only be accepted for the current examination period
- Your appeal must state the specific facts why the grade should be overturned
- The Administrative Director will consider appeals of test questions and will arrive at a decision based solely on the written appeal and any other supporting documentation submitted by the physician
In other words, the decision will rest on your written appeal and the supporting documentation you send along with it, so any physician looking to appeal a failing QME grade should strive to make a compelling case.
