From time frames to administrative procedure, every aspect of med-legal reports in California seems clear cut, at least from the standpoint of the law. But what happens when you need more time to complete a medical legal report? Can you request an extension in that case? Keep reading to find out.
Medical Legal Report Extensions in California
Yes, Qualified Medical Evaluators (QMEs) can request extensions to complete medical legal reports. However, extensions are granted only when certain requisites are met.
The first thing to do is to fill out QME form 112, Time Frame Extension Request. You’ll need to send the original to the California Division of Workers’ Compensation (DWC) with copies to the injured worker and the insurance carrier five days before the report is due to be served to the parties.
Only three types of reasons are considered valid for granting an extension:
- You requested that the injured worker have medical tests and you are waiting for the results
- You requested a consult and are waiting for the consultant’s report
- Good cause (medical emergency for you or your family, death in your family, natural disaster or other community catastrophes that interrupt the operation of the evaluator’s office
Situations like your computer breaking down, an employee quitting, or the carrier failing to provide the injured worker’s medical records or previous medical tests, are NOT reasons for requesting an extension.
Note that extensions for good cause may not exceed 15 days from the date the report is required to be served. However, if you are requesting an extension because you are writing for test results or a consult report, then you may receive a maximum extension of 30 days.
